What are the key points to consider while drafting the clause? What issues can you concede in return for more favourable terms in other parts of the arbitration clause? The recent legislative developments on arbitration, such as the interim measures between mainland China and Hong Kong, and the allowing of third-party funding, further complicate these issues.

Mr. Matthew Gearing QC
Mr. Matthew Gearing QC
Matthew Gearing QC is the Chairperson of Hong Kong International Arbitration Centre and a partner of Allen & Overy Hong Kong office. He is widely regarded as a leading arbitration practitioner; in particular he was appointed Queen's Counsel (England & Wales) in February 2014 and appointed Chairperson of the Hong Kong International Arbitration Centre in 2016.
Matthew has been based in both the London and Hong Kong offices and has acted in a large number of complex and high profile arbitrations around the world, both commercial arbitrations and investment treaty arbitrations. His experience includes arbitrations under the ICC, UNCITRAL, SIAC, HKIAC, KLRCA, SCC, LCIA and ICSID Rules. The subject matter of the disputes has related to joint venture agreements, manufacturing and high technology sectors, disputes relating to complex financial products, and a wide range of disputes in the energy and resources sector.
As well as being a Queen’s Counsel (England & Wales), Matthew is a Solicitor-Advocate qualified in Hong Kong. He routinely appears as advocate in his cases. He has also sat as arbitrator in a variety of matters, as sole and party appointed arbitrator and as Chair.
In addition to the Chair of the HKIAC, Matthew is a past Co-Chair of the LCIA Young International Arbitration Group. He is on the HKIAC, SIAC and KLRCA panel of arbitrators.
Matthew is a joint editor of "Russell on Arbitration" (23rd and 24th Editions) a leading text book on arbitration in England & Wales, and has written and spoken widely on arbitration.
Matthew has achieved broad and consistent recognition in the major directories for many years. He is ranked Band 1 for International Arbitration on a Global-wide basis by Chambers & Partners 2019, as well as being singled out as the sole "Star Individual" for Arbitration - China and ranked Band 1 for Dispute Resolution – India and Band 1 for Dispute Resolution – Philippines. He is also ranked as a Leading Individual by Legal 500 and was named Arbitration Practitioner of the Year at the Asialaw and Benchmark Litigation Asia-Pacific Dispute Resolution Awards 2017 and 2019. In recognition of his contribution to the Asian legal community, in 2019, Chambers & Partners awarded Matthew the Outstanding Achievement Award.

Mr. Kurt Tang
Mr. Tang is the Deputy General Manager of Jinko Power. At the same time, he has been served as Vice President and Global General Counsel for Jinko Group since 2012. Over past nine years, as Senior Executive, he has gained vast execution experiences on legal, compliance, and commercial operations in a fast-growing renewable energy business. He has also extensive legal and transactional experiences in capital market, M&A, outbound investment, corporate and project financing, project development, EPC, and dispute resolutions, both as in-house and external counsel. He also handled international commercial arbitration cases under ICC, HKIAC, UNCITRAL,SIAC and DIS arbitration rules from time to time.

Mr. Michael Tan
Michael has more than 20 years of experience in advising international companies on their operations in and with China. He has profound experience advising industrial clients in various sectors, covering all legal aspects of a typical investment deal like market entry and joint ventures, M&A restructuring and exit. Throughout his two decades’ practice, Michael has been gradually converging his energy on technology driven business and has built up his reputation and connections in the circle.
As the first Chinese partner of Taylor Wessing, Michael is now heading the firm's TMC practice for China. Besides his expertise regarding general corporate and commercial matters, he specializes in IT regulatory and data/privacy protection areas. Michael holds CIPP/E certification as granted by the International Association of Privacy Professionals (IAPP). At the same time, he frequently publishes articles and comments on IT and technology related legal topics.
Michael is National Vice Chair of the Legal & Competition Working Group under the European Chamber of Commerce. He also serves as an arbitrator of the Shanghai International Arbitration Center.
Michael studied law at the University of International Business and Economics in Beijing (UIBE), China, where he also completed his LLB and LLM degrees in 1997 and 2000 respectively. In 2006, Michael received his law doctorate from UIBE. In 1997, Michael was admitted to the Chinese bar. After practicing in domestic law firms, he worked in the Beijing office of a major international law firm from 2000 to 2002. In 2002, he joined Taylor Wessing in the Shanghai office. As of 2007, he has been appointed as a partner of Taylor Wessing.

Mr. Peter Corne
Peter Corne is head of law firm Dorsey & Whitney’s Shanghai office and co-head of Dorsey’s Cleantech Business Group. He is a panelist in several Chinese arbitration and commercial mediation commissions. He conducted as presiding arbitrator the first arbitration between foreign companies in the Shanghai FTZ under SHIAC’s then revolutionary new rules and similarly as mediator conducted the first mediation in the FTZ between foreign companies in the FTZ Court. He is also Adjunct Professor at NYU Shanghai teaching International Mediation and Arbitration.
