In 2019, the China Oil and Gas Piping Network Corporation was established, even as market access was expanded to foreign investors interested in oil and gas infrastructure construction. This signalled that the reform of the gas system continued to deepen. The Government’s strategy and policy gave foreign investors some confidence, however further uncertainty now hinders their enthusiasm.

As a record number of COVID-19 cases spread around the world, things are slowly going back to normal in China. Amid a gradual recovery in production and general business, uncertainties still remain. While the Chinese government has announced several policies aimed at supporting businesses, the full extent of the responses from the government at central and local levels, and speed of recovery from the pandemic in the months to come are yet to be seen.

Among all the difficulties, Government Affairs (GA) teams in multinationals are facing with multiple challenges as well, especially the lack of timely understanding in policies. The reason behind might be the lack of transparency of policy-making process and the discrepancy of Eastern and Western culture. A good and in-depth understanding in policies and their trend is key to corporate operations on daily basis. In today's technology-rich environment, companies increasingly get involved in technology licensing and recognize the value of data as a business asset that should be protected and can be exploited through licensing to other parties for more synergy.

Companies therefore can encounter a range of agreements that implicate the protection and treatment of technology, data and related intellectual property (IP) rights. Where one party is seeking to exploit a software, a data feed or has developed a database it wishes to license, data and IP issues may be the specific focus of a transaction. However, those issues also arise as an ancillary consideration in other licenses and commercial transactions, e.g. technology services arrangements or as capital contribution for joint ventures.
