A year ago, the National People’s Congress passed the very first amendment to China’s Anti-monopoly Law (“AML”), which took effect from 1st August 2022. The amended AML brings about important changes, including on key aspects of companies’ business operations such as distributor pricing. In March 2023, the State Administration for Market Regulation (“SAMR”) adopted four regulations to implement the amended AML. These implementing regulations came into force very recently, on 15 April 2023.

Insight Sharing on the European Union Foreign Subsidies Regulation

On 12 January 2023, the Foreign Subsidies Regulation (FSR) entered into force. This new set of rules for addressing distortions caused by foreign subsidies will allow the European Union (EU) to remain open to trade and investment, while aiming at ensuring a level playing field for all companies operating in the Single Market. The FSR was proposed by the Commission on 5 May 2021. Following the ordinary legislative procedure, the final text of the Regulation was adopted on 10 November 2022 by the Parliament and on 28 November 2022 by the Council.

Recently, the National Development and Reform Commission, the People's Bank of China, member units of the Inter-ministerial Joint Conference on the Establishment of the Social Credit System, and other relevant departments have studied and drafted the Social Credit System Establishment Law (Draft for Comments), and publicly solicited comments. In recent years, the establishment of social credit system has been addressed in several regulations and policy documentations, and comprehensive pilots has been carried out in the practice of local social credit legislation in various areas.

近期国家发展改革委、人民银行会同社会信用体系建设部际联席会议成员单位和其他有关部门研究起草了《社会信用体系建设法(向社会公开征求意见稿)》,并向社会公开征求意见。近年来,社会信用制度体系建设在多部法规及政策文件中有所涉及,并在多地有地方社会信用立法的实践进行综合探索。
